Terms & Conditions

Last updated: 27 July 2026

1. Who you are contracting with

LumeSafe is owned and operated by Zero88 Pty Ltd (trading as "LumeSafe"), based in Australia ("we", "us", "our"). By creating an account or continuing to use LumeSafe you agree to these Terms. If you do not agree, please stop using the service. You must be of legal age in your jurisdiction, or have authority to bind the organisation you sign up on behalf of.

Questions about these Terms: saintethels@gmail.com.

2. The service

LumeSafe is a community safety app for walkers, runners and shift workers. It provides a live map of user-submitted "Spark" alerts, Beam pairing, trusted-circle sharing and responder tools. Alerts are user-generated community signals, not verified facts. Always contact emergency services in a real emergency.

3. Acceptable use

You must not misuse LumeSafe. This includes: any unlawful use; fraud or spam; submitting false, fabricated or malicious alerts; harassing, stalking, doxxing or intimidating any person; posting hateful, threatening, discriminatory, sexually explicit or defamatory content; infringing anyone's intellectual property; and interfering with the security of the service (malware, probing, scraping, circumventing limits). We have zero tolerance for objectionable content or abusive users.

You are responsible for keeping your account credentials confidential and for activity under your account, and for providing accurate information.

4. Reporting and moderation

Every alert has in-app Report and Block user controls. Reported content is reviewed and actioned within 24 hours. Blocking hides that user's alerts from you immediately. We may remove content, restrict features or suspend accounts to keep the community safe.

5. Responder verification

Responder credentials are reviewed manually. Misrepresenting your identity, licence or affiliation is grounds for immediate removal and may be referred to the relevant authority.

6. Intellectual property

We retain all ownership of LumeSafe and its intellectual property, including the software, design, branding, documentation and all underlying technology. We grant you a limited, non-exclusive, non-transferable, revocable right to use the service within the plan you have selected. You may not copy, reverse engineer, resell, redistribute or create derivative works from the service. You keep ownership of the content you submit and grant us a limited licence to host, process and display it solely to operate the service.

7. Plans, payment and subscriptions

LumeSafe offers a free tier, individual subscriptions (monthly or yearly), a one-off 24-hour pass, and organisation plans. Current prices and inclusions are shown on our pricing page and at checkout. Prices are in USD unless stated otherwise and exclude, or include, taxes as calculated at checkout.

Subscriptions renew automatically at the end of each billing period (monthly or yearly) until cancelled. You can cancel at any time; cancellation takes effect at the end of the current paid period and you keep access until then. The 24-hour pass is a one-off purchase and does not renew. If a payment fails, we may suspend paid features until payment is resolved.

Payment, billing, tax, invoicing, cancellation and refund mechanics are handled by Paddle. See Paddle's Buyer Terms and our Refund Policy.

8. Merchant of Record

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

9. Service level and warranties

LumeSafe is provided "as is" and "as available". We do not guarantee uninterrupted or error-free performance, the availability of GPS or network coverage, or the accuracy of any single alert. To the fullest extent permitted by law we disclaim all implied warranties, including merchantability and fitness for a particular purpose. Nothing in these Terms excludes rights you have under the Australian Consumer Law or other non-excludable law.

10. Liability

To the extent permitted by law, we are not liable for indirect, consequential or special damages, including loss of profits, data or goodwill. Our aggregate liability is limited to the fees you paid in the 12 months before the claim. We do not exclude liability for fraud, death or personal injury where the law prohibits it. You indemnify us against claims arising from your content, unlawful use, or breach of these Terms.

11. Suspension and termination

We may suspend or terminate your access for material breach of these Terms, non-payment, security or fraud risk, or repeated or serious policy violations. You may close your account at any time from Settings. On termination your access ends and your personal data is deleted or anonymised in line with our Privacy Notice.

12. General

These Terms are governed by the laws of Queensland, Australia, and the courts of that jurisdiction have non-exclusive jurisdiction. You may not assign these Terms without our consent; we may assign them in a merger or acquisition. Neither party is liable for delays caused by events beyond reasonable control. We may update these Terms as the service evolves — continued use after an update means you accept the changes.
